Santa’s Wonderland Sexual Harassment Policy

1. Purpose

This policy outlines the commitment of Santa’s Wonderland to maintaining a workplace free from sexual harassment. We are dedicated to fostering a safe, respectful, and inclusive environment where all employees, contractors, clients, and visitors are treated with dignity and professionalism.

2. Scope

This policy applies to all employees, contractors, interns, volunteers, clients, and visitors within the workplace or any work-related events or activities, including virtual interactions.

3. Definition of Sexual Harassment

Sexual harassment includes unwelcome sexual advances, requests for sexual favors, or other verbal, non-verbal, or physical conduct of a sexual nature when:

● Submission to such conduct is made explicitly or implicitly a term or condition of employment.
● Submission to or rejection of such conduct is used as a basis for employment decisions.
● The conduct has the purpose or effect of creating an intimidating, hostile, or offensive work environment.

Examples of sexual harassment include but are not limited to:

● Unwelcome touching, hugging, or physical contact.
● Inappropriate or sexually explicit jokes, comments, or gestures.
● Displaying sexually suggestive materials, images, or emails.
● Persistent requests for dates or personal contact after being refused.
● Comments or questions about someone’s body, appearance, or sexual orientation.
● Any form of sexual coercion or threats.

4. Rights and Responsibilities

● Employees: All employees are responsible for ensuring their conduct does not violate this policy. They are encouraged to report any behaviour they believe constitutes sexual harassment.
● Managers and Supervisors: Managers and supervisors must act immediately when aware of potential violations and are responsible for fostering a respectful and inclusive workplace. They must treat all complaints seriously and ensure they are addressed promptly and confidentially.
● The Organisation: Santa’s Wonderland will take all reports of sexual harassment seriously and will act promptly to investigate and address any incidents. Retaliation against individuals who report sexual harassment or participate in investigations will not be tolerated.

5. Reporting

Sexual Harassment Employees who believe they have experienced or witnessed sexual harassment are encouraged to report it promptly. Reports can be made through the following channels:

● Reporting directly to their manager or supervisor.
● Contacting the Event Directors.
● Submitting a complaint via staff@santaswonderland.com.au
All complaints will be handled confidentially to the extent possible and investigated promptly and impartially.

6. Investigation Process

● Upon receiving a complaint, an impartial investigation will be conducted promptly.
● Both the complainant and the accused will be treated fairly and given the opportunity to present their perspective.
● The investigation will be documented, and findings will be shared with relevant parties as appropriate.

7. Consequences of Misconduct

If sexual harassment is found to have occurred, appropriate corrective action will be taken, which may include:

● Counselling or training.
● Written warnings.
● Suspension or termination of employment.
● Legal action if applicable.
False or malicious complaints may also result in disciplinary action.

8. Retaliation

Prohibited Retaliation against anyone who reports sexual harassment or participates in an investigation is strictly prohibited. Any acts of retaliation will result in disciplinary action, up to and including termination.

9. Training and Communication

Santa’s Wonderland may provide training to employees, contractors, supervisors and management on recognising, preventing, and addressing sexual harassment. This policy will be communicated to all employees and included in the employee handbook.

10. Review of Policy

This policy will be reviewed periodically to ensure it remains current and effective. Any updates or changes will be communicated to all employees.

Acknowledgment Employees are required to acknowledge they have read and understood this policy upon onboarding and whenever updates are made.
